Custom Bot Agreement

This Custom Bot Agreement ("Agreement") is a binding legal document between Mizumi ("we," "us," "our") and the individual or entity ("you," "the client") purchasing a custom, privately hosted version of the Mizumi bot (the "Service"). By purchasing or using the Service, you agree to be bound by these terms.

1. Service Description

We provide the software, initial setup, hosting infrastructure, and ongoing maintenance for a custom instance of the Mizumi bot. The functionality and features of the bot are determined by the plan you purchase (e.g., "Basic Plan," "Enterprise Plan").

2. Client Responsibilities

As the owner and operator of your custom bot instance, you are solely responsible for:

  • All content generated by the bot in your server(s).
  • Moderating your community and the bot's interactions to ensure they comply with all applicable terms.
  • The actions of all users who interact with your bot.
  • Configuring the bot's features, including any adjustable content filters, in a responsible manner.

3. Content Policy and Acceptable Use

Your use of the Service is subject to the terms of service of our third-party service providers, including but not limited to:

  • Discord's Terms of Service: Your bot's behavior must not violate Discord's policies. NSFW content may only be generated in channels explicitly marked as age-restricted.
  • AI Provider's Terms of Service: The underlying AI models have strict usage policies. You agree not to use the Service to intentionally generate content that is illegal, hateful, abusive, or in violation of their policies. We reserve the right to suspend your Service if your use of the AI API is flagged for violation.
  • Hosting Provider's Terms of Service: Your bot must not be used for activities that violate our hosting provider's acceptable use policy, such as generating illegal adult content.

4. Owner-Controlled Content Filters (Enterprise Plan)

If you purchase a plan that includes "Owner-Controlled Content Filters" or "Adjustable Safety Layers," you are granted the ability to disable certain automated safety features (e.g., the Guard AI). When you disable these features:

  • You acknowledge that the bot may produce more unfiltered, mature, or potentially offensive content (including NSFW content).
  • You accept full and sole responsibility for this content and its consequences.
  • You confirm that the bot will only be used in environments (e.g., age-restricted Discord channels) appropriate for such content.

5. Limitation of Liability and Indemnification

To the fullest extent permitted by law, Mizumi shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. This includes any damages arising from content generated by the bot, conflicts within your community, or actions taken against your account by third-party platforms.

You agree to indemnify, defend, and hold harmless Mizumi, its developers, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or your violation of this Agreement.

6. Termination

We reserve the right to terminate or suspend your Service immediately, without prior notice or liability, if you breach this Agreement or the terms of any of our third-party providers. Upon termination, your right to use the Service will cease immediately.
