Mizumi Terms of Service

This Terms of Service ("Terms") is a binding legal agreement between you, the user, and the Mizumi Project ("we," "us," or "our"), the provider of the Mizumi Discord bot ("Service"). By inviting, using, or interacting with our Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

1. Description of Service

Mizumi is an entertainment service that provides users with a customizable, AI-powered companion for conversational roleplaying on the Discord platform. The Service includes both Safe-for-Work (SFW) and Not-Safe-for-Work (NSFW) functionalities, which are governed by the rules outlined in these Terms.

2. Age Requirements

This is a strict and non-negotiable policy.

  • By using Mizumi in any capacity, you represent that you are at least 13 years of age and meet the minimum age requirement for using Discord in your country.
  • To access any feature designated as "Advanced Persona," "NSFW Mode," or any other adult-oriented content, you must be at least 18 years of age or the age of legal majority in your jurisdiction.
  • Activating these features requires you to pass an age gate confirmation. This confirmation is a legally binding declaration that you meet this age requirement. Providing false information is a direct violation of these Terms.

3. The Zero Tolerance Protocol

To ensure the safety of our platform, Mizumi employs an automated safety system. If you self-identify, suggest, or roleplay as being a minor (under the age of 18) within an age-restricted context, our automated systems will immediately and permanently revoke your access to all age-restricted features of the Service.

Appeals: If you believe this action was triggered in error during a legitimate, good-faith roleplay scenario, you may appeal the decision by opening a support ticket in our official Discord server. However, this appeal process does not apply to any statements, jokes, or claims made about being underage outside of a direct roleplaying context. We treat all such statements as truth for the purpose of platform safety.

4. User Conduct and Prohibited Activities

You agree not to use the Service to:

  • Adherence to Discord's Policies: You must, at all times, abide by the Discord Terms of Service and Community Guidelines. A violation of their policies while using our Service is considered a violation of our Terms.
  • Generate, solicit, or promote any content that is illegal, such as child sexual abuse material (CSAM) or extreme violence.
  • Engage in hate speech, harassment, or discrimination against any individual or group.
  • Attempt to "jailbreak," reverse-engineer, or manipulate the AI's core safety instructions and filters.
  • Spam, flood, or otherwise disrupt the normal operation of the Service.
  • Use the Service for any commercial purpose without our express written consent.

Violation of these conduct rules may result in your immediate and permanent suspension from all or part of the Service.

5. AI-Generated Content

The content generated by Mizumi is the result of a probabilistic language model. You acknowledge that:

  • Conversations are generated by an AI and do not represent the opinions or beliefs of the developers.
  • AI-generated content may be inaccurate, nonsensical, or, in rare cases, offensive, despite our extensive safety measures.
  • The content provided by Mizumi is for entertainment purposes only and should never be considered factual, medical, legal, or financial advice.

6. Premium Features & Subscriptions

We offer optional, premium tiers through platforms like Patreon ("Subscriptions"). Subscriptions grant you access to enhanced features, such as additional persona customization options, an extended conversation context window, and a larger token allowance. We reserve the right to change the benefits of any subscription tier at any time. If your access to the Service is terminated due to a violation of these Terms, you will not be eligible for a refund for any subscription fees.

7. Intellectual Property

The Mizumi Service, including the bot's name, code, original artwork, and the "Mizumi" character persona, are the exclusive intellectual property of the Mizumi Project. We grant you a limited, revocable, non-exclusive license to use the Service for personal, non-commercial purposes as intended by these Terms.

8. Termination

We reserve the right to suspend or permanently terminate your access to all or part of the Service at our sole discretion, without prior notice, for any reason, including but not to a breach of these Terms.

9. Disclaimer of Warranties and Limitation of Liability

The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. We make no warranties, express or implied, regarding the operation, availability, or reliability of the Service. To the fullest extent permitted by law, the Mizumi Project shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.

10. Changes to These Terms

We may modify these Terms at any time. We will provide notice of significant changes, typically through an announcement in our official Discord support server. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
